U.S., collection of Tariffs struck down by the Supreme Court. Trump pushes additional 15% Tariff
The suspension of the collection of tariffs imposed under the International Emergency Economic Powers Act (IEEPA), which were declared unlawful by the U.S. Supreme Court, will take effect on Tuesday at 12:01 a.m. (6:01 a.m. in Italy).
The announcement was made by the federal agency U.S. Customs and Border Protection (CBP), which is responsible for customs enforcement.
The decision comes just days after the Supreme Court ruling that struck down the tariffs introduced by the Trump administration under the authority granted by the IEEPA. However, the pause may be short-lived: President Donald Trump is reportedly preparing to introduce a new global tariff of 15%, relying on a different legal basis to replace the measures that were just invalidated.
The customs agency has not provided guidance on potential refunds for importers who have already paid the tariffs declared unlawful. It also clarified that the suspension applies exclusively to tariffs imposed under the IEEPA and does not affect other duties enacted by the Trump administration, including those introduced under Section 232 of the Trade Expansion Act, related to national security, and Section 301 of the Trade Act, concerning trade practices deemed unfair.
